Whistleblower Policy

Our Commitment
We are committed to maintaining a safe, fair, and honest environment for everyone at Les Mills New Zealand.

If you ever see or hear something that doesn’t seem right, we want you to feel confident to speak up.

We take all concerns seriously and will act on them in a fair and respectful way.

What Is Whistleblowing?
Whistleblowing is when you raise a concern about suspected:
-    Misconduct
-    Illegal activity
-    Breaches of our policies or rules
-    Health and safety risks
-    Serious misuse of funds or resources
This can relate to actions by staff, contractors, or members.

When to Speak Up
You should speak up if you:
-    Witness or suspect wrongdoing
-    Feel unsafe or believe someone else is at risk
-    Notice behaviour that goes against our values, rules, or the law
You don’t need to be certain - if something feels wrong, it’s okay to raise it.

How to Report a Concern
You can raise your concern in any of these ways:
1.    In person – Speak to a manager you trust.
2.    Via our Complaints process – Found under the Contact Us section of our website
3.    By email – Send details to [email protected]. This email is monitored only by People and Performance and the EA to the CEO.

Please provide as much information as you can (what happened, when, where, who was involved).

What Happens Next
-    Your concern should be acknowledged within two working days.
-    We will assess the information and decide on the next steps.
-    Where appropriate, a fair investigation will take place.
-    We will keep you updated on the progress and outcome where we can (some details may need to remain confidential).

Reference to the Protected Disclosures (Protection of Whistleblowers) Act 2022
In some cases, the Protected Disclosures (Protection of Whistleblowers) Act 2022 may apply.
This law gives special legal protections to people who report serious wrongdoing in the workplace, such as unlawful acts, gross mismanagement, or significant health and safety risks, when they make the report in good faith through the correct channels.
For most member concerns about club matters, this Act will not apply, but we will still treat your report seriously and confidentially. If you believe your concern might fall under this law, we can guide you on the process and how to make a protected disclosure.

Your Protection
If you speak up in good faith:
-    You will not be treated unfairly or face negative consequences for raising a concern.
-    Your identity will be kept confidential as far as we possibly can, in line with our legal obligations.
-    Retaliation or victimisation against whistleblowers will not be tolerated.

False or Malicious Reports
We encourage open, honest and factual reporting. Making a knowingly false or malicious report is not acceptable and may result in action being taken.
